Members of the Delaware County Sheriff’s Office and New York City Department of Environmental Protection Police, executing a search warrant on State Highway 23 in the Town of Roxbury hamlet of Grand Gorge on September 13, located and seized 53 marihuana plants and approximately nine ounces of processed marihuana.

Sheriff’s Investigators obtained a search warrant for the property and residence owned by Mark Racioppi Tuesday morning following an investigation commenced by Sheriff’s Investigators and NYC DEP Police as a result of New York City Land Management personnel discovering marihuana being cultivated on a parcel of NYC owned land located on Racioppi’s Road and on the adjoining property determined to be owned by Racioppi within plain view of the NYC parcel.

On September 14, Town of Roxbury Constable Stephen Williamson assisted the sheriff’s office in locating and arresting the property owner, Mark Racioppi, 47, at his residence.

Sheriff’s investigators subsequently charged him with the class D felony offense of Criminal Possession of Marihuana in the Second Degree and the class A misdemeanor offense of Unlawfully Cultivating Cannabis. Racioppi is accused of unlawfully cultivating and possessing more than 16 ounces of marihuana.

New York State Police at Margaretville arrested Colby M. Russo, 21, of Margaretville on September 12 for the misdemeanor of criminal obstruction of breathing or blood circulation and the violation of harassment 2nd.

This arrest occurred after troopers were made aware of a dispute that had occurred at a home on Thompson Hollow Road in the Town of Middletown. An investigation determined that on September 11, Russo had punched and choked the victim during an argument.

Russo was arraigned in the Town of Middletown where he was released on his own recognizance. An order of protection was issued by the court against him.
